Hire a Lawyer After a Car Accident
Haven't you always wanted to do that once you
hear the sound of a crashing Bottle you never forget it car wrecks can happen in
an instant one of the questions I get asked all the time is when do you need to
hire a lawyer the job of a lawyer is to sit down and explain to all of your
rights and obligations after a wreck we want to make sure that you understand
what you're legally entitled to and what you're legally required to do people
may hire a lawyer if they've had serious injuries in a car wreck they may have issues
as far as long term permanency or lost wages were worried about paying their
medical bills or you may have been involved in a car wreck involving multiple
automobiles?
Three or four vehicles or even a dozen on a highway pileup one of
the things that a lawyer's job is to do is to get out and do an investigation
to try and figure out in what order things happen and who is at fault and
responsible for the collisions there may also be a situation that involves a
complicated car wreck, for instance, those involving tractor trailers
Then not
only regulated by state law but also by federal law and the lawyer's job is
to determine the interaction of those two sets of walls at the end of the day
my job as a lawyer is to make sure I've explained all of the rights and options
available to my client in their case it's important to note that it's not the
lawyers hire a lawyer after an accident. Should I wait or
should I hire one now?
Should I deal with the insurance company
first? Should I complete my medical treatment before I decide to hire
an attorney? These are all excellent questions and I’ll
provide some of the answers in this video. If the accident was not
your fault and you were injured and you need medical treatment you
should contact an attorney sooner than later. Don't wait because
the insurance adjuster is already hard at work on the other side
trying to do as much as they can to ensure that they have to pay out
as little as possible to you.
This means they will call and ask you questions, take recorded statements of you that they may be able to use against you later, and obtain statements of their witnesses. The insurance adjuster is already hard at work trying to protect the other party; the one that caused your injuries. You should have representation of your own to ensure that your rights are protected and that you can recover all of your damages when the time comes.
Insurance adjusters may offer you a small amount of money now in order to
limit the amount of money that they have to pay you later on
when your damages are more fully known. Therefore, it is important
to wait to understand, to really get a true understanding, of what your
full damages are before you try to resolve a case. A good, competent
personal injury attorney should know this and should protect your
interests. I've been
practicing law since 1989 here in Broward and I have an office in Naples I
do cases all over the state of Florida so it's never too early to hire a lawyer
after a car accident case many insurance companies don't want you to know that
they're praying that you don't hire a lawyer right away in fact they've got a
whole group of adjusters that are dedicated to trying to make contact with you
quickly especially
If it's the other driver's fault their companies going to want to try and reach out to you and get a statement from you and get you to tell them in a recorded statement, your version of the accident but then, they'll also ask you questions about your prior medical history about what things you could have done maybe to avoid the collision even if it was their driver's fault. So, they're going to start probing and gathering from you, any information you're willing to give them while you're still in a cordial mood and thinking that they're going to be cooperative with you and that they're out there to try and help you.
So, when you get a lawyer right away, the lawyer will of course tell you, to speak with the other driver's insurance company right away. That doesn't mean you're hiding anything from them. It means that you want to have your lawyer listening to what questions they're asking you and hearing what answers you're giving them. You want to make sure that your lawyer is protecting you and that the insurance company doesn't start asking you questions that you're not prepared to answer or that are outside the scope of what would be appropriate. Um, they're not entitled to see right off the bat prior medical history and any prior medical records.
So, that's something that you want to sit down with your lawyer and go over ahead of time. If you've had prior injuries, your lawyer may want to gather those medical records and go over them with you. Uh before you provide information to an insurance company because they could subpoena those records, they may want to contact witnesses if you tell them the name and phone number of the person that was in your car, you probably would want your lawyer to speak with them and interview them before you let the insurance adjuster for the other side talk to them.
Uh so, you don't realize that when you give a statement to an insurance company at the beginning of a case before you hire a lawyer, they're going to just ask you for all of the information that they know they're never going to get right away if you have a lawyer. So, just be mindful of that fact that they're hoping you don't get a lawyer and they're hoping that you provide them all of the detailed information that you know, it's like a phishing expedition to them. Maybe there's something that they get from you that wouldn't have gotten if you had a lawyer stopping you and maybe that helps their case and helps them save a little bit of money for their insurance company at your expense so be careful
